Terms of Service

These Terms of Service ("Terms") govern your access to and use of Space Exiles, a game operated by Moai Games Mateusz Wisniewski ("Moai Games", "we", "us", or "our").

By creating an account or using Space Exiles, you agree to these Terms.

If you do not agree to these Terms, do not create an account or use the Service.

1. Eligibility

You must be at least 13 years old to create and use a Space Exiles account.

If the laws applicable to you require consent from a parent or legal guardian to use the Service, you may use Space Exiles only with that consent.

If you are a parent or legal guardian permitting a minor to use the Service, you are responsible for their use of the Service to the extent provided by applicable law.

2. Your Account

You are responsible for maintaining the confidentiality and security of your account credentials.

You must provide information that is reasonably accurate where information is required to create or maintain an account.

You may not:

• sell, rent, steal, or fraudulently obtain another player's account;
• access another player's account without authorization;
• impersonate another person or entity;
• create accounts for fraudulent or abusive purposes; or
• attempt to bypass account restrictions or suspensions.

You are responsible for activity performed through your account to the extent permitted by applicable law.

3. Game Rules and Fair Play

Space Exiles is a persistent multiplayer strategy game in which players compete and interact within shared game worlds.

Normal gameplay actions against other players, including attacks, espionage, competition for rankings, and other mechanics intentionally provided by the game, are part of the Service and are not by themselves considered harassment or misconduct.

You must not:

• use cheats, hacks, bots, automation, scripts, exploits, or unauthorized software to gain an unfair advantage;
• intentionally exploit bugs or vulnerabilities to obtain an unfair advantage;
• interfere with or disrupt the Service or its servers;
• attempt to access server systems, APIs, accounts, or data without authorization;
• manipulate network traffic or game requests in order to bypass game rules;
• fraudulently manipulate purchases, rewards, rankings, resources, or virtual items;
• knowingly assist others in cheating or exploiting the Service; or
• use the Service for unlawful purposes.

If you discover a significant exploit or security vulnerability, please report it to us rather than abusing it.

4. Player Names and User Content

Certain information chosen by players, including player or profile names, may be visible to other players.

You must not use names or other user-created content that:

• is sexually explicit or obscene;
• promotes hatred, discrimination, or violence against protected groups;
• threatens, harasses, or abuses another person;
• promotes child exploitation or abuse;
• promotes terrorism or violent extremism;
• encourages illegal activity;
• impersonates another person, organization, or Moai Games;
• reveals another person's private information without authorization;
• infringes intellectual property or other legal rights; or
• is otherwise seriously offensive or inappropriate for the Service.

We may remove or modify user-created content, require a player to change a name, restrict an account, or take other reasonable moderation action when these rules are violated.

Players may report inappropriate player content or behavior using reporting mechanisms made available through the Service or by contacting moaigamesdev@gmail.com.

5. Enforcement

We may investigate suspected violations of these Terms.

Depending on the circumstances, we may:

• issue a warning;
• remove or modify inappropriate content;
• rename a player or profile;
• remove improperly obtained resources or virtual items;
• temporarily restrict access to features;
• suspend an account; or
• permanently terminate an account.

We may take immediate action where reasonably necessary to protect players, the Service, or its integrity.

Where appropriate, enforcement decisions may take into account the seriousness, frequency, and circumstances of the violation.

Nothing in this section limits rights that you have under applicable law.

6. Virtual Items and Currency

Space Exiles may contain virtual resources, currencies, items, upgrades, or other digital content ("Virtual Items").

Virtual Items are part of the Service. Except where applicable law provides otherwise, they do not represent real-world money, property, or a financial instrument and cannot be redeemed from Moai Games for cash.

We may modify game balance, availability, statistics, costs, or functionality of Virtual Items as part of operating and balancing the game.

We will not intentionally remove purchased digital content in a manner that violates applicable consumer law.

7. Purchases

Space Exiles may offer optional purchases of digital content or Virtual Items.

Purchases made through Google Play or another distribution platform are processed through that platform and may also be subject to its payment terms and policies.

Prices and available products may vary by country, platform, currency, or applicable taxes.

Refund rights are governed by applicable law and, where relevant, the rules and procedures of the platform through which the purchase was made.

Nothing in these Terms removes any mandatory consumer rights that apply to you.

8. Game Worlds, Updates, and Changes

Space Exiles is an evolving online game.

We may add, modify, rebalance, or remove gameplay systems, units, buildings, technologies, missions, worlds, events, rewards, progression systems, or other game content.

We may also release new game worlds and maintain, merge, close, reset, or otherwise modify game worlds where reasonably necessary for operation of the Service.

Where a change materially affects purchased content or your legal rights, applicable consumer law continues to apply.

9. Availability and Maintenance

Space Exiles requires online services to provide much of its functionality.

We do not guarantee that the Service will always be available without interruption or error.

The Service may become temporarily unavailable because of:

• maintenance;
• updates;
• technical failures;
• internet or hosting failures;
• security incidents;
• third-party service failures; or
• circumstances outside our reasonable control.

We will make reasonable efforts to maintain the Service but cannot guarantee uninterrupted availability.

10. Intellectual Property

Space Exiles, including its software, artwork, graphics, game systems, designs, text, audio, characters, logos, and other content provided by Moai Games, is owned by or licensed to Moai Games and is protected by applicable intellectual property laws.

These Terms give you a limited, personal, non-exclusive, non-transferable, and revocable right to use the Service for personal entertainment in accordance with these Terms.

They do not transfer ownership of Space Exiles or its intellectual property to you.

You may not copy, distribute, sell, reverse engineer, modify, or commercially exploit protected elements of the Service except where such restriction is prohibited by applicable law.

11. Privacy

Our processing of personal data is described in the Space Exiles Privacy Policy, available through the game and at spaceexiles.com.

The Privacy Policy forms an important part of understanding how the Service operates but does not limit any privacy rights provided to you by applicable law.

12. Account Deletion and Termination

You may stop using Space Exiles at any time.

You may request deletion of your account using the deletion functionality provided through the Service or the account deletion process available through spaceexiles.com.

We may suspend or terminate access to the Service where you materially or repeatedly violate these Terms, where necessary to protect the security or integrity of the Service, or where otherwise permitted by applicable law.

Account deletion is generally permanent and may result in loss of game progress, Virtual Items, rankings, worlds, reports, and other account-associated data.

13. Disclaimers and Liability

We provide Space Exiles with reasonable care and skill as required by applicable law.

To the maximum extent permitted by applicable law, we are not responsible for losses caused by circumstances outside our reasonable control or by misuse of the Service contrary to these Terms.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law, including mandatory consumer protections.

14. Changes to These Terms

We may update these Terms to reflect changes to the Service, applicable law, security requirements, or our business practices.

If a change materially affects your rights or obligations, we may provide reasonable notice through the Service, our website, or another appropriate method.

Continued use of the Service after updated Terms become effective constitutes acceptance where permitted by applicable law. Where applicable law requires separate consent, we will request it.

15. Governing Law

These Terms are governed by the laws of Poland, without depriving consumers of mandatory protections available under the laws applicable to them.

If you are a consumer residing in the European Union or another jurisdiction providing mandatory consumer protections, nothing in these Terms limits rights that cannot legally be waived or restricted by contract.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
